Ownership of real estate in Türkiye is transferred through official registration at the Land Registry Directorate. A sales agreement, payment and handover are important parts of a transaction, but legal ownership is established through the official land registry process.
Foreign buyers in particular should verify the property's legal status, required documentation and the latest rules applicable to them before completing the transaction.
What Is a Title Deed?
The title deed and land registry record contain the official ownership and registration details of a property. Information about the location, property type, independent unit and registered owner is recorded in the land registry system.
1. Check the Land Registry Record
Before purchasing, verify the title deed information and confirm that the seller is the registered owner. Mortgages, liens, annotations, easements and other restrictions that could affect the transaction should be reviewed.
Depending on the property, its intended use, construction status and relevant municipal or technical records may also require review.
2. Prepare the Required Documents
The documents required for a title deed transaction vary according to the parties and the type of transaction. Foreign buyers may be required to provide a valid passport or identity document and certified translations where applicable.
If a transaction is completed through a power of attorney, the document must contain the necessary authority for the property transaction and be valid for use in Türkiye.
3. Submit the Land Registry Application
Once the documents are ready, an application is submitted for the title deed transaction. After review, the parties are informed about the required transaction and payment steps.
Application channels and electronic services can change, so the current procedures of the General Directorate of Land Registry and Cadastre should be followed.
4. Official Fees and Transaction Costs
A property transfer may involve title deed charges, revolving-fund service fees and other official transaction costs. The way these amounts are calculated can vary according to current regulations, the type of transaction and the applicable tariff.
For this reason, buyers should not rely on fixed service-fee amounts from previous years. Current official assessments and charges should be confirmed before completion.
5. Declare the Sale Value Correctly
The sale value used in the title deed transaction should be declared in accordance with the rules applicable at the time of transfer. Incorrect or incomplete declarations may result in additional tax, fee, interest or penalty consequences.
Both parties should therefore ensure that their declaration and payment obligations are completed according to the current regulations.
6. Signature and Registration
After the required checks and payments are completed, the buyer and seller, or their duly authorized representatives, complete the official transaction.
Once registration is completed, legal ownership is recorded in the buyer's name.
Additional Checks for Foreign Buyers
Acquisition of real estate by foreign natural persons can be subject to nationality rules, location-based restrictions and statutory acquisition limits. Additional documents or assessments may be required in some transactions.
Foreign buyers should therefore confirm that they are eligible to acquire the selected property before making a substantial payment or commitment.
What Should Be Checked Before Title Deed Transfer?
- Confirm that the seller is the registered owner.
- Check mortgages, liens and other title restrictions.
- Verify the property and independent-unit details.
- Clearly document the payment plan and agreed sale conditions.
- Confirm the current official charges and transaction costs.
- Check the scope and validity of any power of attorney.
- Verify current acquisition rules applicable to foreign buyers.
How Long Does Title Deed Transfer Take?
Timing depends on the workload of the relevant Land Registry Directorate, completeness of the documents, the legal status of the property and whether additional review is required. It is therefore not appropriate to guarantee a fixed completion time for every transaction.
